TERMS AND CONDITIONS

Terms: Net 30 days. All invoices will be subject to interest charges of 1 ½% overdue 30 days or more from date service was performed. (NO EXCEPTIONS.) Account will automatically be placed on credit hold for any service overdue for payment of more than 90 days. Service will resume when delinquent amount is paid in full; however, we will not be responsible for any damages or consequences that may occur to your lawn. Bounced checks will be assessed a $ 35.00 service charge.

Cancellations: Cancellation of this program can be made any time during the season via written notice or telephone confirmation. Any and all services rendered up to and including cancellation are due within the 30-day payment term.

WARRANTY OF SERVICE AND PERFORMANCE OF PRODUCTS

Colson’s Landscaping, Inc. may not be held responsible for any mechanical injury to treated areas applied by other persons or companies not employed by Colson’s.
Colson’s is not responsible for weather related injury to any treated areas at any time, including lack of rainfall and drought damage.
Irrigation of any treated areas is solely the customer’s responsibility and failure to properly irrigate treated areas may result in poor product and/or plant performance of treated areas for which Colson’s assumes no liability.

Colson's Landscaping, Inc. is not responsible for turf injury due to lack of irrigation when homeowner is vacationing / not irrigating for other reasons.

Colson’s Landscaping, Inc. agrees to provide all products, materials, labor, and equipment necessary as outlined in various programs in a workmanship manner.

DISCLAIMERS

Colson’s is NOT responsible for unmarked sprinkler heads or damage which may occur to cable lines or sprinkler pipes that are less than 2 ½” deep.
Colson’s is NOT responsible for any deer or mole damage/mole activity in customer’s property. The mole’s main diet is subterranean earthworms and insects, not grubs. Law DOES NOT allow us to apply pesticides to kill earthworms.
